2. Scope
These terms of sale apply to the distance selling of original artworks by Philippe Guesdon to consumer buyers, whether concluded on the online shop philippe-guesdon.sumupstore.com or by email or phone.
Placing an order implies acceptance of the terms in force on the date of the order. They can be viewed, saved and printed at any time on this page.
3. The artworks
Each artwork is a unique, original, signed piece, supplied with a certificate of authenticity. Its main characteristics (title, technique, medium, dimensions, year) are given on its product page.
Photographs are as faithful as possible. Slight colour differences may appear depending on the screen used; brushwork, texture and the irregularities inherent to a handmade work are not defects.
As each artwork is unique, it is sold subject to availability. Should an artwork prove unavailable after ordering, the buyer will be informed without delay and refunded in full.
4. Prices
Prices are given in euros. VAT is not applicable (article 293 B of the French Tax Code): the displayed price is the total price of the artwork.
Shipping costs are shown before the order is confirmed. The applicable price is the one displayed at the time of the order.
5. Order and payment
Orders are placed on the online shop. Payment is due on ordering and is made securely online through SumUp, using the payment methods offered at the time of the order. Philippe Guesdon has no access to the buyer's banking details.
The sale is concluded upon confirmation of payment. An order confirmation is sent by email.
For a sale concluded by email or phone, the terms (artwork, price, shipping costs, lead time) are confirmed in writing before payment.
6. Delivery
Artworks are shipped within France and to most of Europe. For other destinations, shipping costs are quoted before ordering. Each artwork is carefully packed for transport.
The delivery time is stated at the time of the order; failing that, the artwork is delivered no later than 30 days after the sale is concluded. Hand delivery is possible in Orléans, by appointment.
The risk of loss or damage passes to the buyer when the buyer, or a third party designated by the buyer, takes physical possession of the artwork. Please check the parcel on receipt and report any damage to the carrier and by email as soon as possible.
7. Right of withdrawal
The buyer has 14 days from receipt of the artwork to withdraw from the purchase, without giving any reason (article L.221-18 of the French Consumer Code).
To exercise this right, the buyer must inform the seller of the decision by an unequivocal statement, by email to contact@philippeguesdoncreations.fr or by post to the address above. The withdrawal form at the end of this page may be used, but is not compulsory.
The artwork must be returned no later than 14 days after notification, carefully packed, in good condition and with its certificate of authenticity. Return shipping costs are borne by the buyer. For a large format these costs can be significant; an estimate can be requested before purchase.
Philippe Guesdon will refund all sums paid, including the initial delivery costs (on the basis of standard delivery), no later than 14 days after being informed of the withdrawal. The refund may be withheld until the artwork has been received or proof of its return shipment has been provided. It is made using the same means of payment as the original order.
The buyer may be held liable for any diminished value of the artwork resulting from handling other than what is necessary to establish its nature and characteristics.
8. Legal guarantees
Artworks are covered by the legal guarantee of conformity and the legal guarantee against hidden defects, as follows:
The consumer has two years from delivery of the goods to claim under the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to prove the existence of the lack of conformity, not when it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without significant inconvenience.
If the goods are repaired under the legal guarantee of conformity, the initial guarantee is extended by six months.
If the consumer asks for a repair but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.
The consumer may obtain a price reduction while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
- the seller refuses to repair or replace the goods;
- the repair or replacement takes place after thirty days;
- the repair or replacement causes significant inconvenience to the consumer, in particular where the consumer permanently bears the cost of collecting or removing the non-conforming goods, or the cost of installing the repaired or replacement goods;
- the lack of conformity persists despite the seller's unsuccessful attempt to remedy it.
The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer then does not have to request repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.
These rights derive from articles L.217-1 to L.217-32 of the French Consumer Code.
A seller who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L.241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept, or a full refund against return of the goods.
As an original artwork is unique, it cannot be replaced by an identical one: the guarantee is implemented by repair (restoration) where possible, or by price reduction or refund.
9. Intellectual property
Buying an artwork transfers ownership of the physical object, but not the copyright (article L.111-3 of the French Intellectual Property Code). Any reproduction, display or distribution of the work (prints, merchandise, commercial use…) requires Philippe Guesdon's prior written consent. The buyer is of course free to photograph the work at home for private use.
10. Personal data
Data provided when ordering (name, addresses, email, phone) is used solely to process the order, delivery and follow-up, and is never passed on to third parties other than necessary service providers (SumUp for the shop and payment, the carrier for delivery). It is kept for the legal retention period for accounting records.
Under the GDPR, the buyer has the right of access, rectification, erasure and objection, by writing to contact@philippeguesdoncreations.fr, and may lodge a complaint with the French data protection authority, the CNIL. See also the legal notice.
11. Complaints and mediation
For any question or complaint, the buyer may write to contact@philippeguesdoncreations.fr or to the postal address above.
In accordance with article L.612-1 of the French Consumer Code, if a dispute is not resolved after a prior written complaint, the consumer may refer it free of charge to the seller's consumer mediator: CM2C — www.cm2c.net (membership in progress; the membership number will be shown here as soon as it is issued).
12. Governing law
These terms are governed by French law. In the event of a dispute, and failing an amicable solution, the competent courts are those designated by ordinary rules of law. Consumer buyers retain the benefit of the mandatory provisions of the law of their country of residence.
